The Prime Minister issued Decree No. 59/2022/ND-CP establishing electronic identification and authentication

The Prime Minister issued Decree No. 59/2022/ND-CP on September 5, 2022, establishing electronic identification and authentication.

This Decree outlines the rights and obligations of service users, as well as the duties of pertinent government entities, businesses, and people. It also addresses electronic identity, electronic identification, and electronic authentication.

Accordingly, the electronic identification and authentication system keeps a permanent record of the information related to the electronic identity account. For a period of five years following the date of account use, historical data on account usage is kept in the electronic identity and authentication system.

The authentication of an e-ID account has 4 levels. Level 1: e-ID accounts are authenticated using the authentication factor outlined in Article 3 Clause 9 and the specified authentication methods outlined in Article 3 Clause 10 of this Decree without the use of biometric data.

Level 2: When biometric information is not available, the authentication of electronic identity accounts is carried out using two different authentication factors as specified in Clause 9 Article 3 and corresponding authentication means in Clause 10 Article 3 of this Decree.

Level 3: In accordance with Clause 9 Article 3 and the related authentication methods in Clause 10 Article 3 of this Decree, which include biometric information, the authentication of electronic identity accounts is carried out using two or more distinct authentication elements.

Level 4: E-ID accounts are authenticated using portrait pictures, fingerprints, and data from the Citizen Identity Database or Citizen ID card, among other authentication elements.

This Decree’s notable provision is that Vietnamese citizens are free to issue and use electronic identification accounts. In particular, the cost of registering for an e-identity account and the cost of using an e-identity account, as decided by the system generated electronic identification and authentication, are not payable by the e-identity subject who is an agency, organization, or citizen of Vietnam.

On October 20, 2022, this Decree becomes effective.
