New export C/O form RCEP applied from 01/01/2023

On November 18, 2022, the Minister of Industry and Trade issued Circular 32/2022/TT-BCT amending Circular 05/2022/TT-BCT on Regulations on Rules of Origin of Goods in the Economic Partnership Agreement. regional comprehensive (RCEP).

Accordingly, Appendix III on the C/O form, form RCEP for export and the form of supplemental declaration of C/O at point c, clause 1, Article 4 of Circular 05/2022/TT-BCT shall be replaced with Appendix II attached to the Circular. 32/2022/TT-BCT .

This new C/O form RCEP export and this new C/O supplemental declaration form will be applied from January 1, 2023.

In addition, Appendix I on specific rules at Point a, Clause 1, Article 4 of Circular 05/2022/TT-BCT is replaced with Appendix I attached to Circular 32/2022/TT-BCT.

According to the provisions of Article 5 of the Circular No. 05/2022/TT-BCT dated February 18, 2022 by the Minister of Industry and Trade, stipulating the Rules of Origin of goods in the Regional Comprehensive Economic Partnership Agreement (hereinafter: referred to as Circular No. 05/2022/TT-BCT), this Appendix sets forth the provisions for determining the origin of goods.

The criteria “goods which are wholly obtained or wholly produced in a Member State” and “goods produced in a Member State solely from materials originating in one or more Member States” refer to the following criteria: Clauses 1 and 2, Article 5 of Circular No. 05/2022/TT-BCT  are applied to all product lines.

Some terms in the Appendix are construed as follows:

a)  Section is part of the Harmonized System of Commodity Description and Coding.

b) Chapter is the first two digits of the commodity code in the Harmonized Commodity Description and Coding System.

c) Group is the first four digits of the commodity code in the Harmonized Commodity Description and Coding System.

d) Subheading is the first six digits of the commodity code in the Harmonized Commodity Description and Coding System.

Circular 32/2022/TT-BCT takes effect from January 1, 2023.
